Manufacturers and first suppliers

If you suspect (or reasonably ought to suspect) that the goods you manufacture or supply are dangerous goods, you must determine whether this is the case before the goods are supplied or used.

If you determine that the goods are dangerous goods, you must also:

  • prepare a material safety data sheet (MSDS)
  • provide a current MSDS to any person to whom the goods are supplied for the first time
  • review and revise the MSDS
  • ensure that the dangerous goods are assigned an appropriate class, subsidiary risk and packing group
  • ensure compliance with relevant legislation covering package marking

Suppliers

All suppliers of dangerous goods must provide a current MSDS to any person to whom the goods are supplied for the first time. You must not supply the goods if you suspect (or reasonably ought to suspect) that the goods have not been appropriately classified, packaged or marked. 

Retailers

This requirement does not apply to retailers who supply the goods in a container provided by the purchaser. However, retailers are still required to ensure, as far as practicable, that the container is suitable.
